A major legal dispute regarding clinical titles has successfully concluded, preserving a patient safety framework that relies heavily on clear credential distinctions. The American Society of Anesthesiologists successfully opposed two trademark applications submitted by the American Association of Nurse Anesthesiology, which attempted to legally register trademarks featuring the term “Nurse Anesthesiologist.”

Following a prolonged multi-year review before the U.S. Trademark Trial and Appeal Board, the nursing association withdrew its requests, resulting in an outright rejection of the labels with prejudice. We view this decision as an important safeguard for transparency, ensuring that individuals undergoing surgery can accurately recognize the training and credentials of those managing their anesthesia care.

Many of our supporters are anesthesiologists. We commend and thank them and their specialty society for advocating so strongly for credential clarity.

Blending or conflating professional terminology by allowing mid-level anesthesia nurses to use variations of doctor titles directly compromises patient safety by inducing widespread public misunderstanding. Fully qualified anesthesiologists must navigate medical school, comprehensive residency programs, and thousands of hours of highly demanding specialized preparation.

“Anesthesiologists are specialized physicians,” stated ASA President Patrick Giam, M.D., FASA, explaining that utilizing misleading vocabulary “deprives patients of their right to know the qualifications of the professionals providing their medical care.” Ensuring clinical credentials remain accurately defined helps protect patients’ rights to understand exactly who is supervising their critical surgical procedures.
