The AMA reports that exponential growth of “medical spas” in the United States has outpaced the development of necessary safety regulations, leaving many facilities to operate without essential physician oversight. Research from the American Medical Association reveals that approximately 70 percent of these establishments are not affiliated with a traditional physician practice, frequently using staff who lack the comprehensive training of a medical doctor.

This lack of professional integration is caused by a regulatory void in 36 states where no specific laws exist to govern how these centers are owned or managed. In the absence of physician-led care, the emphasis often shifts away from patient well-being toward commercial interests, creating a hazardous environment for those seeking cosmetic treatments.

Professional medical supervision is vital for managing the inherent risks associated with advanced aesthetic procedures such as laser treatments and chemical peels. According to Dr. Rachel Kyllo, patients who suffer injuries in unregulated settings often lack the legal protections provided by the medical-legal system because many independent spas do not carry standard malpractice insurance. “Regulatory reform for medical spas in the U.S. should focus on establishing consistent standards across states to improve patient safety and care quality,” emphasize industry experts.

By mandating that a licensed, highly-trained physician directs clinical operations and supervises nonphysician staff, states can better protect the public from life-altering complications and ensure that all medical interventions meet the highest standards of safety.
